Terms of Service & Liability Disclaimer

These terms govern all emergency flood mitigation work performed by MuckSquad in St. Catharines and the Niagara Region. Booking a dispatch means you accept them.

1. Scope of service

MuckSquad is an emergency, non-structural flood mitigation contractor. Our scope is limited to:

  • Emergency debris and standing-water extraction
  • Carpet, underpad and tack strip removal and disposal
  • 2-foot drywall and baseboard flood-cuts
  • Floor scrubbing and botanical disinfectant surface sanitization
  • Itemized damage photo cataloging for insurance and government relief claims

MuckSquad does NOT perform licensed electrical work, gas fitting, plumbing repairs, structural engineering, mould remediation certification, or reconstruction/rebuild services.

Where such work is required, we will stop and advise you to engage the appropriate licensed trade. We do not certify a property as safe, dry, mould-free or habitable.

2. Property access authorization

By booking a service you authorize MuckSquad crews, vehicles and equipment to enter the designated property — including basements, crawlspaces, garages, driveways and adjacent yard areas — at the scheduled time to perform the emergency work described above, and to remove and dispose of damaged materials from the property. You confirm you are the owner, or are authorized by the owner, to grant this access.

3. Pre-existing hazards & limitation of liability

Flooded properties frequently contain hazards that are not visible at the time of booking. To the fullest extent permitted by Ontario law, MuckSquad is not liable for:

  • Pre-existing mould growth, spore spread, or air-quality conditions present before our arrival
  • Contamination originating from sewage backup or overland floodwater
  • Pre-existing structural decay, rot, foundation cracking, settling or framing failure revealed during removal work
  • Hidden or undisclosed electrical, gas or plumbing hazards concealed behind finishes
  • Damage to items, wiring, ductwork or fixtures concealed within materials that must be removed as part of the agreed scope
  • Consequential losses, business interruption, or claim denial by your insurer

You agree to disclose any known hazard before crews begin work. Our total liability for any claim is limited to the amount you paid for the affected job.

4. Payment terms

The standard base rate is $1,500 CAD per emergency muck-out job, or a custom written quote where scope, square footage or disposal volume differs. HST is applied where applicable.

Payment is due in full upon completion of the work, on-site, by e-Transfer (dispatch@mucksquad.com), cash, or credit card.

Invoices are issued in an adjuster-ready format so you can submit them to your insurer or to a DRAO/FLAP claim. MuckSquad bills the property owner directly; we are not a party to your insurance contract and payment is not contingent on your claim being approved.

5. Cancellation & access failure

Cancel or reschedule by calling 1-833-400-MUDD / 1-833-400-6833 as early as possible. If a crew is dispatched and cannot access the property, a callout fee may apply.

6. Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. This page is provided for clarity and is not legal advice; last updated 2026.
